What Injuries Have You Suffered On the Job in Philadelphia?

Various types of work-related injuries and illnesses are covered under Pennsylvania’s workers’ compensation laws. If your injury or illness developed under the course of your employment, you may have a compensable claim. Specifically, according to the Pennsylvania Supreme Court, you have a compensable claim if your injury is related to your employment.

Musculoskeletal injuries

Musculoskeletal Injuries

Any injury that damages the tendons, bones, muscles, ligaments, or nerves is a musculoskeletal injury. These injuries are associated with debilitating pain and result in limited use while the injury heals. Sometimes the damage is permanent, resulting in limited function and/or nerve damage.

These types of physical injuries make up 40% of all reported work-related injuries in Pennsylvania. Heavy lifting, manual labor, and repetitive motions can all cause musculoskeletal injuries. Common musculoskeletal injuries include:

  • Strains
  • Sprains
  • Fractures
  • Back Injuries
  • Shoulder Injuries
  • Neck Injuries
  • Repetitive Use Injuries

Musculoskeletal injuries can negatively impact Philadelphia Penn workers’ ability to perform necessary job duties, and, if left unaddressed, workplace accidents can cause serious pain, damage, and financial loss for the employee.

Traumatic injuries

Traumatic Injuries

Traumatic injuries are sudden and severe physical injuries that require immediate medical attention. These injuries are often life-altering and can result in permanent disability.

Often the result of workplace accidents, falls, or dangerous work conditions, traumatic injuries account for 30% of all workplace injuries.

Traumatic injuries include:

  • Broken Bones
  • Traumatic Head Injury
  • Severe Lacerations
  • Accidental Limb Amputations
  • Loss of Fingers or Toes
  • Loss of an Eye
  • Heat Burns or Chemical Burns
Occupational illnesses

Illnesses or Diseases

Illness or diseases that develop over time due to workplace conditions are called occupational illnesses. The Pennsylvania Workers Compensation Act covers many occupational diseases. In fact, PA workers compensation law assumes that any illness or disease that develops in someone who worked at a job where there were occupational hazards is a work-related illness.

Occupational illnesses include:

  • Various Cancers
  • Asbestosis
  • COPD
  • Tuberculosis
  • Other Respiratory Illnesses
Mental health conditions

Emotional Trauma

Pennsylvania workers compensation law also protects employees who suffer emotional trauma or a combination of emotional and physical trauma in the workplace. Pennsylvania workers can file three different types of mental health-related workers compensation claims:

  • A physical/mental claim – an employee must prove a bodily injury resulted in them suffering a mental health condition.
  • A mental/physical claim – an employee must prove an external mental health stressor caused them to develop a physical injury.
  • A mental/mental claim– an employee must prove a traumatic event or a continuous mental health stressor caused them to develop a debilitating psychological injury or condition.

How to Win Big

So, how do you Win Big? First things first, do not speak to your employer’s insurance company. They are trying to manipulate you to protect their bottom line, and they certainly aren’t fighting on your behalf.

Follow these steps to give yourself the best shot at winning big—

File A Claim

You’ll first need to file a LIBC-500 form which starts the workers compensation process. After this, you need to file your claim. You have a limited amount of time to file your workers’ compensation claim in Pennsylvania. Under Pennsylvania law, you’ll need to notify your employer within 120 days of your injury (or within 21 days of your injury to receive retroactive benefits).

Collect All Information Regarding Your Claim

This step is crucial. The more documentation and information you can gather regarding the incident and its medical aftermath, the stronger your claim will be. Gather everything from witness accounts and injury scene photographs to medical records and pay stubs that prove lost wages. An experienced workers’ compensation attorney can help you figure out all the data you’ll need for a successful claim.

Take Meds and See Your Doctor

Under PA law, your employer can have you see a doctor of their choosing. However, you can also see your own doctor after 90 days. Make sure you also see a doctor of your choice if you feel your employer’s recommendation was biased. Be sure to follow the doctor’s directions completely. Failure to listen to doctor recommendations may weaken your claim.

FAQs About Pennsylvania Workers Compensation Claims in Philadelphia, PA

Here are some frequently asked questions our clients often raise.

Employers and insurance companies may deny claims for several reasons. They frequently argue that workplace injuries did not occur while in the course of their employment, were not work-related, or that they resulted from employee misconduct.

It’s your employer’s insurance company’s job to deny your claim. It’s our job to prevent them. An experienced workers’ compensation lawyer knows all the tricks insurance companies pull to prevent paying out due compensation. If your claim was denied, it isn’t the end. Rather, it’s the beginning.

The length of time workers compensation benefits are paid out depends on the specific circumstances of your case and injury. If you are unable to work and rated as temporarily totally disabled, you can collect benefits, such as recuperating lost wages, for 104 weeks under Pennsylvania Law before your employer can request an Impairment Rating Evaluation to determine if you remain disabled.

If you are rated as permanently partially disabled, you can collect benefits for up to 500 weeks under Pennsylvania Law.
